Australia: DIY jihad book conviction overturned

June 9, 2011

Belal Saadallah Khazaal, of Lakemba, in Sydney’s south-west, was jailed for at least nine years in September 2009.

A NSW Supreme Court jury found him guilty of making a document – between September 20 and 23, 2003 – connected with assistance in a terrorist act, knowing of that connection.

The 110-page book was titled: Provisions on the Rules of Jihad – Short Judicial Rulings And Organisational Instructions For Fighters And Mujahideen Against Infidels.

Today, the NSW Court of Criminal Appeal allowed his appeal against conviction and ordered a retrial.

Because stupidity is not necessarily a crime…

Update 2012-08-09: The High Court has upheld his conviction. Looks like stupidity is a crime after all.
